Terms and Conditions
1. Who we are
This website is operated by Flight Corner Pty Ltd (ABN 91 694 615 702), trading as Flight Scanner ("Flight Scanner", "we", "us"), Victoria, Australia. Contact: contact@flights-scanners.com. Postal address: 553 Melton Highway, Sydenham, Victoria, Australia. Flight Scanner is a registered Australian trademark (No. 2596157). Flight Scanner holds IATA accreditation No. 02368575.
By searching, booking or otherwise using this website you agree to these Terms. If you do not agree, please do not use the website.
2. Our role
We are an online travel agent. We help you search for and book hotel accommodation. The accommodation is provided by the hotel, not by us. When you book, a contract for accommodation is made between you and the hotel. We arrange the booking as your agent, and we are not the owner or operator of any hotel.
Rates, availability and hotel content come from third-party suppliers, including our booking platform partner. We do not control the hotels or their services.
3. Eligibility and your details
- You must be at least 18 and able to enter a binding contract. The lead guest must be 18 or older.
- Information you give us must be true, complete and current. Names must match the guest's passport or photo ID.
- You are responsible for everyone you book for, and you confirm you have their permission to give us their details.
4. Prices and payment
- Prices are shown in local currency and are the total for your whole stay for the rooms, guests and dates you searched, unless we say otherwise.
- Prices can change until you complete payment, and availability is not guaranteed until you receive a booking confirmation.
- Payment is taken on our payment partner's secure checkout page. We do not see or store your full card details.
- Your bank or card issuer may charge foreign-exchange or card fees. These are outside our control.
- We do not add a surcharge for paying by card.
- If a price is clearly wrong because of an obvious error, we may cancel the booking and refund you in full.
5. Booking confirmation
Your booking is confirmed only when we send you a confirmation email with a booking reference. If you do not receive one within 24 hours of paying, contact us straight away at contact@flights-scanners.com. If a booking cannot be completed after payment (for example, the hotel no longer has the room), we will tell you promptly and refund you in full or help you choose another option.
6. Cancellations, changes and refunds
These are covered in the Cancellation, Amendment and Refund Policy, which forms part of these Terms.
7. Your responsibilities as a guest
- Check the hotel's check-in time, ID, or any deposit and age rules. The hotel may require a card or cash deposit on arrival.
- Follow the hotel's rules. The hotel may refuse entry or end a stay for misconduct, with no refund.
- Check that you hold the visas, passports, health documents and travel insurance you need. We strongly recommend travel insurance. We are not responsible if you are refused entry to a country.
- Contact the hotel directly about special requests (bed type, early check-in, accessibility). These are requests only and are not guaranteed unless the hotel confirms them.
8. Hotel information and ratings
Hotel descriptions, photos, star ratings, facilities and policies are supplied by hotels and suppliers. We take reasonable care but cannot guarantee that they are complete or current. Star ratings are indicative only and may differ between countries.
9. What we are and are not responsible for
- We are responsible for the services we provide, to the standard required by law.
- We are not responsible for the acts or omissions of hotels and other third parties, including overbooking, changes to facilities, building works, hotel closure, relocation to a comparable hotel, quality of service, loss or damage to belongings, or injury at the hotel. Your claim for these is generally against the hotel. We will give reasonable help in dealing with the hotel.
- We are not responsible for events outside our reasonable control (force majeure), such as natural disasters, pandemics, war, terrorism, strikes, government action, or failure of power, internet or telecommunications.
10. Australian Consumer Law and your rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Nothing in these Terms removes or limits any right you have that cannot be excluded by law, including under consumer law elsewhere (for example, EU, UK and other mandatory consumer protections).
To the extent the law allows, our liability to you for any other loss is limited, at our choice, to supplying the service again or paying the cost of having it supplied again, or, if that is not allowed, to the amount you paid us for the affected booking. We are not liable for indirect or consequential loss, loss of profit or loss of enjoyment, except where the law does not allow us to exclude it. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or anything else that cannot lawfully be excluded.
11. Acceptable use
You must not: use the website for any unlawful purpose; make false, speculative or fraudulent bookings; use bots, scrapers or automated tools without our written permission; try to disrupt, probe or hack the website; resell our content or rates; or use the website to compete with us. We may suspend access or cancel bookings that we reasonably believe breach these rules, and report unlawful activity to the authorities.
12. Intellectual property
The website, its design, logos and software are owned by us or our licensors. "Flight Scanner" is a registered trademark. You may use the website for personal, non-commercial booking only. Hotel photos and descriptions belong to their owners.
13. Privacy and cookies
We handle personal information as described in our Privacy Policy.
14. Complaints
Tell us first at contact@flights-scanners.com with your booking reference. We will acknowledge within 2 business days and aim to resolve within 14 days. If you are still unhappy, you can contact your state or territory consumer affairs agency, or the Australian Competition and Consumer Commission (ACCC). Nothing here stops you using any dispute or chargeback rights you have with your card issuer.
15. Changes to these Terms
We may update these Terms. The version published when you book applies to that booking. Continued use of the website after a change means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of Victoria, Australia, and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria. This does not remove any right you may have to bring a claim in the courts of your own country where mandatory consumer law gives you that right.
17. General
If any part of these Terms is unenforceable, the rest still applies. Our failure to enforce a right is not a waiver. We may transfer our rights under these Terms to a successor to our business. You may not assign yours without our consent. These Terms, with the Privacy Policy and the Cancellation, Amendment and Refund Policy, are the entire agreement between you and us about the website. If we provide a translation, the English version prevails to the extent the law allows.
